These Terms of Service ("Terms") govern your access to and use of k4d websites and products operated at https://www.k4d.io and related subdomains (including escrow, pay, sign, and docs) (collectively, the "Service"). By using the Service, you agree to these Terms.
1. Who we are
k4d provides human-first interfaces for crypto workflows built on MoonX (authentication and passkey wallets), optional PayBox agent funding, and related tools such as USDC escrow deals, tip/unlock pay links, and signed guestbook walls. We are not a bank, broker, exchange, or custodian of your private keys.
2. Eligibility
You must be able to form a binding contract in your jurisdiction and must not use the Service if applicable law prohibits it. You are responsible for complying with sanctions, export, tax, and crypto-asset rules that apply to you.
3. Accounts and authentication
Sign-in is provided through MoonX (email one-time codes and/or OAuth such as Google or Apple). Wallet operations require passkey / WebAuthn step-up. You are responsible for the security of your email, OAuth accounts, devices, and passkeys. Notify us promptly if you believe your account was compromised.
4. Products
- Escrow. Deals between parties involving USDC funding, lock, release, or refund flows. You are solely responsible for counterparty risk, deal terms you agree off-platform, and verifying addresses and amounts before signing.
- Pay. Tip or unlock links settled in USDC. Creating or paying a link does not create an employment, partnership, or agency relationship with k4d.
- Sign. Public or embeddable walls of signed messages. Do not post unlawful, infringing, or abusive content.
- Docs / skills. Informational builder docs. Official MoonX, PayBox, and x402 documentation remain normative for those products.
5. Agents and PayBox
If you connect PayBox or another agent host, you authorize scoped agent actions under the grants you approve. You remain responsible for agent spend, approvals, and revocation. k4d does not control third-party agent runtimes (Cursor, Claude, ChatGPT, custom bots, etc.).
6. Blockchain and third parties
On-chain transfers are irreversible once confirmed. Network fees, congestion, facilitator outages, RPC failures, and third-party services (MoonX, PayBox, MoonPay, chains, bridges) are outside our exclusive control. We do not guarantee settlement times or continuous availability.
7. Acceptable use
You agree not to:
- Violate law, including fraud, money laundering, or sanctions evasion
- Abuse authentication (credential stuffing, OTP farming, automated mass signup)
- Interfere with the Service, scrape abusively, or attempt unauthorized access
- Use the Service to harm minors or distribute malware
- Misrepresent affiliation with k4d, MoonX, PayBox, or MoonPay
8. Fees
k4d may introduce product fees; any fees will be disclosed in the relevant UI before you confirm. Blockchain network fees and third-party facilitator or ramp fees are separate and charged by those networks or providers.
9. Intellectual property
The Service (branding, UI, docs, and software we publish) is owned by k4d or its licensors. You retain rights to content you submit, and grant us a license to host and display it as needed to operate the Service (for example, sign-wall entries and deal metadata you create).
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Crypto assets are volatile and risky. Nothing on the Service is investment, legal, or tax advice.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, k4d AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID TO k4d FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
12. Indemnity
You will indemnify and hold harmless k4d and its operators from claims arising out of your use of the Service, your content, your deals or payments, or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate access if you breach these Terms or create risk to the Service or others. You may stop using the Service at any time. Provisions that by nature should survive (including disclaimers, limitations, and indemnity) will survive.
14. Changes
We may update these Terms. The effective date above will change when we do. Continued use after changes become effective constitutes acceptance. Material changes may also be surfaced in-product where practical.
